These terms govern use of spiiritsreservee.com, operated by Toni Lee Karaitiana as a sole trader under the trading name Spirits Reserve. Purchases are also governed by our Terms of Sale, Shipping Policy, and Returns, Refunds and Consumer Guarantees policy.

1. Using the store

You may use the store for lawful browsing and purchasing. You must have the legal capacity required for a purchase or the necessary permission from a parent or legal guardian. Provide accurate contact and order information and protect any account credentials.

You must not misuse accounts, introduce malicious code, interfere with security or store operation, make unauthorised transactions, or use the store to violate another person's rights.

2. Products and descriptions

We sell drinkware and related accessories. Alcoholic beverages are not included or sold. Product descriptions identify the actual items and quantities supplied. Photographic props are not included unless expressly listed. Product information and imagery must accurately represent what is supplied; these terms do not excuse misleading descriptions or material differences.

3. Content and feedback

Website content, trademarks, and images belong to their respective rights holders. You may use them only with permission or as permitted by law. Reviews must reflect genuine experiences and must not infringe another person's rights. Honest criticism is not prohibited merely because it is negative.

4. Platform and third-party services

Shopify provides the ecommerce platform. Your seller is Toni Lee Karaitiana, not Shopify. Third-party websites or services may have separate terms. Maintenance or technical interruptions may affect access, but they do not remove our responsibilities for accepted orders, personal information, or legal remedies.

5. Consumer protections and responsibility

Nothing in these terms excludes, restricts, or modifies consumer guarantees, remedies, or liabilities that cannot lawfully be excluded. This includes protections under the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986 where applicable, and under the Australian Consumer Law for our sales to consumers in Australia. We do not impose a blanket waiver of responsibility for defective goods, misleading descriptions, or delivery failures.

6. Governing law and disputes

These terms are governed by the laws of New Zealand, subject to mandatory consumer protections that apply to your purchase, including the Australian Consumer Law. This choice does not limit those protections or prevent you from bringing a claim before a court or tribunal available under applicable law. These terms do not impose exclusive jurisdiction or mandatory arbitration.

Contact us to seek a resolution to a complaint. Doing so does not remove your right to use lawful remedies or contact an appropriate regulator.

7. Changes

Changes apply to future use after publication. Orders remain subject to the terms presented when the contract was formed, and later changes do not remove existing rights. If a term is unenforceable, applicable law governs without reducing mandatory consumer protections.
